5:05 p.m. Update
Two witnesses in the Aubrey Childers case were heard on Monday, Nov. 7, 2011 immediately after jury selection. The state called Rene Williams and Robert Carey, Jr. to the stand. The trial will resume on Tuesday, Nov. 8, 2011, at 9 a.m.

Jury selection for the Aubrey Childers trial was chosen around 3:40 p.m. on Monday, Nov. 7,2011, and began immediately. Check back for updates.
Jury will be selected after 1:30 p.m. today for the trial against Aubrey Phillip Childers who was indicted by the Nolan County Grand Jury. Childers was charged with sexual assault, a second degree felony, enhanced to a first degree felony with one prior conviction. Court documents state that Childers sexually assaulted the victim, knowing that the victim did not consent and was unconscious or physically unable to resist or unaware that the sexual assault was occurring.
The indictment stemmed from an arrest made on the male-on-male sexual assault case that took place on Aug. 15, 2010 around the southwest part of Sweetwater. Aubrey Phillip Childers of Sweetwater, was arrested on Monday, Dec. 27, as he was being processed out of the Texas Department of Criminal Justice.â€¨According to Lt. Randy Hanes with the Sweetwater Police Department, DNA evidence was obtained at the scene of the crime and evidence was gathered for a warrant to obtain DNA from the suspect. A DNA sample was taken from Childers after he was arrested for a parole violation. The DNA was then sent to the Lubbock Department of Public Safety Laboratory for testing.
