McClinton receives 22 years |

Bryson Leshon McClinton of Sweetwater received a total of 22 years confinement in the Texas Department of Criminal Justice with two of those years being in the State Jail Division, during 32nd Judicial Court proceedings held Monday with Judge Glen Harrison presiding.
McClinton was arrested in July 2008 with four others in Sweetwater on drug related charges, McClinton's charge being possession of a controlled substance, namely cocaine, with intent to deliver. As a result of a joint operation between the District Attorney’s Office, Sweetwater Police Department and the Nolan County Sheriff’s Office, about 155 grams of crack-cocaine and just under an ounce of marijuana was seized from a Sweetwater residence at 605 East Oklahoma Street in 2008. Also arrested were Sharonda Emerson of Snyder, Adrian Greenwood of San Angelo and Christopher King of Dallas. According to a spokesperson from the Sweetwater Police Department, McClinton’s residence was being observed due to information received that he may still be involved with criminal activity, even though he was placed on felony probation earlier in the week for similar charges. During the investigation, Julian Alvarado, 55, of Sweetwater, was observed entering and leaving the East Oklahoma Street residence, and was stopped on suspicion of drug activity. Crack-cocaine was found in his possession, which prompted a search of the home he had just left.. As part of McClinton’s probation agreement, his Fourth Amendment rights were suspended and law enforcement officers were given the right to enter his home without a warrant. Upon entering the home, officers were invited in, where crack-cocaine and marijuana was in plain sight of the investigators, officials said. The drugs confiscated had an estimated street value of $15,000 to $30,000 depending on the increments the substances were being sold in, according to law enforcement officials. It is believed the drugs were manufactured in the Dallas area, then transported to Sweetwater to be sold, the officials added. For the charge of possession with intent to deliver, a first degree felony that occurred July 24, 2008, McClinton received 20 years confinement in the Texas Department of Criminal Justice, will have to pay a $1,000 fine, $370 in court costs, $140 in restitution to the Texas Department of Public Safety Crime Laboratory in Abilene and $3,304.58 in attorney's fees. McClinton also entered a plea of true to revoking his probation that was handed to him only two days before on July 22, 2008, for possession of cocaine. For that plea, he received two years confinement in the State Jail Division of the Texas Department of Criminal Justice. He will also have to pay a $1,000 fine, $301 in court costs, $140 in restitution to the Texas Department of Public Safety Crime Laboratory in Abilene and $500 in restitution to Ashley Regalado of Sweetwater. He will receive 596 days credit towards his sentence for jail time already served. Sharonda Shaunte Emerson also entered a guilty plea for possession of a controlled substance, the lesser included offense of possession with intent to deliver a controlled substance, namely cocaine. She was charged with a second degree felony. Emerson received seven years confinement in the Texas Department of Criminal Justice and had that sentence probated to seven years. She will pay a fine of $1,000, $370 in court costs and $140 in restitution to the Texas Department of Public Safety Crime Laboratory in Abilene. She will also have to serve 240 hours of community service. |
